1. Acceptance of Terms
By accessing and using BoardRack ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Platform Description
BoardRack is a marketplace platform that connects surfboard owners with renters and buyers. We provide the technology and infrastructure but are not party to the transactions between users.
- We facilitate connections between board owners and renters/buyers
- We process payments securely through third-party providers
- We do not own, sell, or rent surfboards ourselves
3. User Accounts
Registration: You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
Eligibility: You must be at least 18 years old to use BoardRack. By using the Platform, you represent that you meet this requirement.
Account Security: You are responsible for all activity under your account. Notify us immediately of any unauthorized access or security breach.
4. Listings and Bookings
Owner Responsibilities: Owners must provide accurate descriptions, photos, and availability. Boards must be safe and in the condition described.
Renter Responsibilities: Renters must treat equipment with care and return it in the same condition. Any damage must be reported immediately.
Booking Confirmation: Once confirmed, bookings are binding. Cancellations are subject to the owner's cancellation policy.
5. Payments and Fees
Payment Processing: All payments are processed through Stripe. By using BoardRack, you agree to Stripe's terms of service.
Platform Fees: BoardRack charges a service fee for facilitating transactions. Fees are disclosed before booking confirmation.
Refunds: Refunds are subject to the cancellation policy of each listing. Platform fees may be non-refundable.
6. Prohibited Conduct
Users may not:
- Provide false or misleading information
- Engage in fraudulent transactions or scams
- Harass, threaten, or abuse other users
- Conduct transactions outside the Platform to avoid fees
- List stolen or counterfeit equipment
- Violate any applicable laws or regulations
7. Liability and Disclaimers
Platform Role: BoardRack is a marketplace platform. We do not own, inspect, or verify the condition of listed boards.
User Risk: You assume all risks associated with transactions made through the Platform. We recommend verifying board condition before completing rentals.
Limitation of Liability: To the maximum extent permitted by law, BoardRack is not liable for any indirect, incidental, or consequential damages arising from use of the Platform.
8. Dispute Resolution
Users are encouraged to resolve disputes directly. BoardRack may provide mediation assistance but is not obligated to do so. Any unresolved disputes shall be governed by the laws of the jurisdiction where BoardRack is registered.
9. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated via email or Platform notification. Continued use of BoardRack after changes constitutes acceptance of modified terms.
10. Termination
We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited conduct. Users may close their accounts at any time through account settings.
